Dear Friends, It would be interested to know that recently Karnataka HC and MP Industrial court have quashed prosecutions against Mr. Naresh Goyal, Chairman of JET Airways and Mr. Ratan Tata, Chairman of Nalco filed by authorities under Contract Labour Act and Factories Act respectively. Mr. Naresh Goyal along with the area manager was prosecuted by Labour Authorities under CLA for certain violations of the Act. Karnataka HC has quashed the prosecution against Mr. Naresh Goyal stating that prosecution should not have been entertained by the Magistrate without stating as to whose was the in charge of the establishment and responsible for the conduct of the business. HC commented while rejecting the prosecution that it would be an instrument in the hands of private complaint as vendetta to harass the persons needlessly. The learned magistrate should have applies his mind before issuing summons to Mr. Naresh Goyal. In another case Mr. Ratan Tata was prosecuted by Factory Inspector for not displaying the Factory License and producing the license at the time of inspection in factory premises. The court quashed the prosecution on the ground that neither Mr. Ratan Tata was Director of the company nor he was nominated as occupier. These can be termed as glaring examples of arbitrariness and highhandedness of law enforcing agencies where they simply go for prosecution to harass the top notch industrialist without mindlessly.
